Terms of Service

These Terms govern your use of OpenClaw ("Service"), operated by Faizyar Industries LLC ("we", "us"). By creating an account or subscribing, you agree to these Terms.

1. The Service

OpenClaw provides a personal AI agent that runs on dedicated cloud infrastructure you control. The agent answers your messages, may access iOS data you grant permission for, and may call third-party LLM providers (DeepSeek by default; Google AI / Gemini if you connect your own key).

2. Subscriptions

• Plans, prices and trial terms are presented at sign-up and managed via Apple's StoreKit. Apple's Standard EULA covers the purchase itself.
• We currently offer a single Standard plan at $10 / month with a 7-day free trial.
• Subscriptions auto-renew unless cancelled at least 24 hours before the period end through your Apple Subscriptions settings.
• Cancellations are not pro-rated; you keep access through the end of the paid period.

3. Acceptable use

You may NOT use the Service to:

• Violate applicable law or facilitate illegal activity.
• Generate or distribute content depicting minors in a sexual context.
• Run automated abuse, spam, or denial-of-service campaigns.
• Reverse-engineer the Service to find security flaws without notifying us first (security@myphoneclaw.com).
• Circumvent per-user rate limits or attempt to access other users' data.

We may suspend your account without notice if we observe abuse that threatens the platform or other users.

4. Bring-your-own-key (BYOK)

If you connect a Google AI / Gemini key:

• Your messages route to your own API quota, billed by Google to your account.
• We do not see your raw key after the initial paste — it is encrypted at rest in our vault.
• You can disconnect it anytime via Settings → Connections.
• We are not responsible for upstream provider outages, billing, policy changes, or model behavior.

5. Content and intellectual property

• You retain ownership of your messages, attachments, and agent outputs you direct.
• Agent outputs are generated by third-party LLMs and may be inaccurate. Don't rely on them for legal, medical, financial, or safety-critical decisions without verification.
• We don't claim ownership of your data and we don't train models on it.

6. Privacy

The collection and handling of your data is described in our Privacy Policy, which is part of these Terms.

7. Service availability

The Service is provided "as is" without warranty. We aim for high uptime but do not guarantee it. Scheduled maintenance windows are posted on status.myphoneclaw.com.

8. Limitation of liability

To the maximum extent allowed by law, our total liability for any claim relating to the Service is capped at the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data.

9. Termination

You may delete your account anytime via Settings → Profile → Delete account. Deletion is final; we cannot restore deleted accounts.

We may terminate accounts that breach these Terms, are dormant for more than 24 months, or whose payment fails for more than 30 days.

10. Changes to these Terms

We may update these Terms; material changes will be announced in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of California, USA. Disputes are resolved in the state or federal courts of San Francisco County, California.
