Terms of Service

These Terms govern your use of OpenClaw ("Service"), operated by Faizyar Industries LLC ("we", "us"). By creating an account or subscribing, you agree to these Terms.

1. The Service

OpenClaw provides a personal AI agent that runs on dedicated cloud infrastructure you control. The agent answers your messages, may access iOS data you grant permission for, and may call third-party LLM providers (DeepSeek by default; Google AI / Gemini if you connect your own key).

The collection and handling of your data is described in our Privacy Policy, which is part of these Terms.

7. Service availability

The Service is provided "as is" without warranty. We aim for high uptime but do not guarantee it. Scheduled maintenance windows are posted on status.myphoneclaw.com.

8. Limitation of liability

To the maximum extent allowed by law, our total liability for any claim relating to the Service is capped at the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data.

9. Termination

You may delete your account anytime via Settings → Profile → Delete account. Deletion is final; we cannot restore deleted accounts.

We may terminate accounts that breach these Terms, are dormant for more than 24 months, or whose payment fails for more than 30 days.

10. Changes to these Terms

We may update these Terms; material changes will be announced in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of California, USA. Disputes are resolved in the state or federal courts of San Francisco County, California.
